Toshakhana case, the trial court cannot decide until the final decision of the High Court, the Supreme Court

 The petition of Chairman PTI was disposed of on the basis of withdrawal by the Supreme Court.

According to the details, the three-member bench of the Supreme Court said in its decision that the trial court cannot decide the Tosha Khana case until the final decision of the High Court. The Election Commission admitted that the trial court cannot make a final decision until the transfer application is decided.


During the hearing, lawyer Khawaja Haris gave arguments and said that yesterday, a merit hearing was held on all the petitions in the High Court. The decision on the request to transfer the case to the High Court is reserved. Justice Yahya Afridi asked whether you have received any interim relief from the High Court. On which Khawaja Haris said that we have not received any relief from the High Court yet.

Justice Yahya Afridi asked lawyer Khawaja Haris what do you want from us today? Lawyer Khawaja Haris said that first the High Court and then the trial court should decide. No decision can be taken by the trial court until the transfer of the case is decided.

Justice Yahya Afridi while giving remarks said that what are the common grounds in the case should be informed to the court. We are looking at the matter beyond legality.

Justice Yahya Afridi said that when the appeals in this case come in due time, then the matter will be looked at, after which the court disposed of the appeals related to the Tosha Khana case.

It should be noted that the Supreme Court had issued a new cause list while changing the hearing bench regarding the Tosha Khana case. Justice Hasan Azhar Rizvi was included in the bench in place of Justice Mazahar Ali Naqvi. A three-member special bench headed by Justice Yahya Afridi heard the case, in which Justice Musrat Hilali was also a part of the special bench.

On the other hand, the case related to Tosha Khana was heard against Chairman Pakistan Tehreek-e-Insaf (PTI). In Session Court Islamabad, the final arguments have been completed by the lawyer Election Commission Amjad Parvez, the final decision is likely to be pronounced today.
