The Supreme Court declared it unconstitutional to conduct a DNA test without consent

 ISLAMABAD : The Supreme Court of Pakistan declared the DNA test conducted without consent as unconstitutional and interference in private life.



Supreme Court Judge Justice Mansoor Ali Shah has issued a 7-page written statement of the property inheritance case, in which the Lahore High Court's order to conduct DNA test of 3 persons has been nullified .In the judgment, it has been said that according to the Shahada law, the paternity of the child born during the marriage cannot be doubted.

According to the decision, private life is related to the right to life of a human being, Articles 9 and 14 of the Constitution guarantee the protection of personal freedom and private life, it is illegal to conduct a DNA test without consent. The judgment further said that certain provisions of the criminal laws allow DNA tests without consent. The judgment further said that certain provisions of the criminal laws allow DNA tests without consent.
