Cipher case: 'It should be decided who has the authority to change the location of the court', Chief Justice Islamabad High Court

 During the hearing in the Islamabad High Court on the plea against the Law Ministry's notification regarding the transfer of the cipher case against former Prime Minister Imran Khan to Attock Jail, the prosecutor of the case, Zulfikar Naqvi, told the court that the cipher case has not yet been tried. And the Ministry of Law has issued a notification of court transfer as per the law.


The Chief Justice of Islamabad High Court remarked that it has to be decided under what authority the notification can be made. He said that the authority can be given to any judge of first class magistrate or above. The prosecutor of this case said that the request to change the venue of the court has become ineffective.



On which the Chief Justice remarked that if the same notification is made again tomorrow, the same question becomes relevant. He said that it should be decided who has the authority to change the location of the court. The Chief Justice said that he did not agree that the petition of the petitioner was ineffective.


Imran Khan's lawyer said that this notification was issued on the basis of malice. He said that the application has not become ineffective, the court has to decide whether the notification was valid or not.

Sher Afzal said that does anyone have an answer as to why Chairman PTI is imprisoned in Attock Jail after the sentence was suspended and why the trial court judge went to Attock Jail on NOC.


Imran Khan's lawyer said that Fazil Judge did not use his mind and left. He said that if the NOC of Landhi Jail comes tomorrow, the judge will go to Landhi.


Sher Afzal Marwat said that in response to our request, it is not enough to say that the notification has become ineffective, but the question before the court is that under which law PTI chairman has been kept in Attock Jail?
